Data protection within schools

The UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA 2018) are in force in the UK. These require any organisation that handles personal data, including schools, to be accountable for the way they hold and manage that data.

Children have the same rights as adults over their personal data which they can exercise as long as they are competent to do so. Where a child is not considered to be competent, an adult with parental responsibility may usually exercise the child’s data protection rights on their behalf.

Each individual primary and secondary school on Anglesey is registered as a data controller with the Information Commissioner’s Office (ICO) as they process personal data.

Each school has a Privacy Notice that gives you information about the data they hold about you, how they use it, your rights in relation to it and the safeguards that are in place to protect it. Each individual school has a Privacy Notice and a Data Protection Policy. Please refer to the relevant school’s website or social media accounts for these or request a copy from the school.

If you have a concern or complaint about the way the schools are collecting or using your personal data, you should raise your concern with the individual school in the first instance, so that they can try to resolve any issues.

Schools Data Protection Officer

The primary and secondary schools on Anglesey have a dedicated Schools Data Protection Officer through the Isle of Anglesey County Council.

The schools data protection officer is independent from the schools and is responsible for:

  • informing and advising schools on data protection legislation and requirements
  • monitoring compliance with data protection legislation
  • helping schools to establish data protection policies and procedures
  • training school staff on their data protection obligations
  • being the point of contact with the Information Commissioner’s Office and you as the data subject

You can contact the Schools Data Protection Officer by email, post or telephone if you have any requests to exercise your legal rights and if you have any queries about the personal data the school holds about you.
